By accessing Brand Motion at https://brandmotion.uz and connecting your YouTube channel to our platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Brand Motion, operated by Maxsud Toshpulatov Murodillo o'g'li. If you do not agree to any part of these Terms, you must not access or use the service.

Brand Motion is a YouTube channel analytics platform that provides content creators with performance insights, audience data visualization, and channel growth analysis. Our service connects to your YouTube account via Google OAuth to retrieve and display your channel's analytics data in an accessible dashboard.

The service is intended exclusively for YouTube content creators who wish to analyze and understand the performance of their own YouTube channels. Use of this service for any other purpose is not permitted.

Brand Motion is provided on an “as available” basis and we reserve the right to modify, suspend, or discontinue any aspect of the service at our discretion.

By using Brand Motion, you agree to the following responsibilities:

• Ownership: You must be the owner of, or have explicit authorization to connect, the YouTube channel you link to Brand Motion. Connecting a channel without authorization is strictly prohibited.
• Lawful use: You must not use Brand Motion for any purpose that is unlawful, fraudulent, abusive, or otherwise prohibited by applicable law. This includes, but is not limited to, data scraping, misrepresentation, or circumventing platform restrictions.
• Account security: You are solely responsible for maintaining the security of your Google account, including your credentials and any connected third-party application access. Brand Motion is not liable for any unauthorized access resulting from your failure to secure your account.
• Accurate information: Any information you provide to Brand Motion must be accurate and up-to-date. Providing false or misleading information may result in termination of your account.

Brand Motion uses YouTube API Services to access and display your channel analytics. By connecting your YouTube account to Brand Motion, you also agree to be bound by the following third-party terms:

We access only the minimum data necessary to provide our service and request only the OAuth scopes required for channel analytics. We do not request write access to your YouTube channel.

Brand Motion values your privacy and handles your data responsibly. The following principles govern our data practices:

• We only access and process data that you explicitly authorize through Google OAuth. We do not access any data beyond what is required for analytics.
• You can revoke our access to your Google account at any time by visiting myaccount.google.com/permissions and removing Brand Motion from connected applications.

To the maximum extent permitted by applicable law, Brand Motion and its operators shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service.

• Analytics accuracy: Brand Motion provides analytics data “as is” without warranties of any kind, express or implied. We make no guarantees regarding the accuracy, completeness, or timeliness of the data presented.
• Business decisions: We are not responsible for any business or content decisions you make based on data or insights provided by Brand Motion. Analytics are informational only.
• Third-party dependencies: We are not liable for any disruptions, inaccuracies, or data loss resulting from YouTube API downtime, changes to YouTube's data policies, or other third-party service interruptions beyond our control.

Brand Motion reserves the right, at its sole discretion, to modify, suspend, or permanently discontinue the service — or any part thereof — at any time, with or without prior notice.

In the event of major changes to these Terms or to the core functionality of the service, we will make reasonable efforts to notify registered users via the email address associated with their account prior to the changes taking effect.

We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

Brand Motion reserves the right to suspend or permanently terminate your access to the service, without prior notice or liability, if you:

• Violate any provision of these Terms of Service.
• Engage in fraudulent, abusive, or illegal activity through the platform.
• Attempt to gain unauthorized access to other users' data or our systems.

You may terminate your account and request deletion of all your data at any time by sending a written request to toshpulatovm73@gmail.com. Upon receipt, your account and all associated data will be permanently removed within 7 business days.

Termination of your account does not relieve you of obligations incurred prior to termination.

These Terms of Service and any disputes arising from or related to your use of Brand Motion shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts located in Uzbekistan, and you hereby irrevocably consent to the personal jurisdiction of such courts.
